I received your letter dated June 2nd 2002.
I understand that you have some concerns with the redwood tree and the fence
that is on our property line. Let me address both of these issues.
1st while I understand you have had a survey of your property performed by
A.C. & H. Civil Engineers. I would not stipulate that this is the
property line shared by you and myself.
However, since you are using it as a reference, it clearly shows that the
fence encroaches, slightly, into each of our yards.
The city of Palo Alto has said, July 1st, that this is a matter to be resolved by you and myself. I see no reason to move the fence and do not agree to do so. Earlier in June, when we spoke, you said that while you believed there was an issue with the orientation of the fence relative to the property line, you were not going to ask that it be moved. Why have you now changed your mind?
Regarding the redwood tree; as we discussed earlier in June, I understand your
concern.
I have no desire to destroy this tree. The city
of Palo Alto has issued a permit, to me, to remove the tree. However,
they respect my decision to side the tree time; time to see if it will survive
the work I have had done to create a spare between the
"burl " (*)
of the tree and the northeast corner of my house.
As I had mentioned before, if the tree does not appear to be surviving and passes a risk to fall then it should be removed; and I appreciate the offer to split the costs (I or and) accept. *) City arborist Dave Doctor (650-329-0318) named the same portion of the tree as a "basal flare"
